I had read that it is illegal for a hospital to detain a patiient for unpaid bills. I guess I assumed the people on the ground in CDO had explored this law. Re: "PLIP" People in or near CDO should read this article, the blogs & my blog post below. This Law came out about two years ago. It is illegal to hold patients in hospitals due to upaid bills. If Mr. Hunt was treated the entire time in a private room, then it may get sticky but it seems the right people are not pushing the issue. PIA Daily News Reader PIA Press Release 2007/05/03 New law breaks hospitals' old practice of detaining patients by Lyndon Plantilla Quezon City (3 May) -- Holding back patients for non-payment of hospital bills is now illegal. Officials of hospitals and similar institutions violating Republic Act No. 9439 (RA 9439) will face six month imprisonment and fines up to P50,000. RA 9439 intends to put an end to some hospitals' cruel habit of detaining patients until they can afford to settle their financial obligations. This practice buried many indigents deeper in debt because some hospitals continued to charge them for their "extended confinement". Naturally expenses skyrocketed higher than what patients have actually incurred during their treatment. Under RA 9439, patients who either "fully or partially recovered but incapable to settle in part or full their hospitalization expenses including professional fees and medicines shall be allowed to leave the hospital" provided they have signed promissory notes. These promissory notes, proof of the patient's commitment to settle unpaid obligations, must be supported by mortgage or guarantee of a co-maker who shares the liability with the patient. Upon the issuance of promissory notes, patients are entitled to medical certificates and other documents. As for the deceased patients, the hospital or medical clinic shall release death certificates and other documents required for internment to their surviving relatives. The new law excludes patients who are treated in private rooms. The Health Department is now working on the law's implementing rules and regulations. I for one was not aware of this ruling. I do know that the hospital has asked for a signed promissory note on behalf of Mr Hunt but it was my understanding that Mrs Hunt's mother was the person asked .Given that they seem to be a family of fairly modest means i do not know if she was found acceptable . I will ask Daisy about verification of this point. The " money trail " that seems to be a point of contention for so many is at best confusing . Part of this may simply stem from the fact that money sent by donors via Expats Charities Daisy is aware of but that is not always the case for other monies sent by Albert or Mrs Hunt . This is due to the fact that money is sent directly to Mrs Hunt's family on Mr Hunt's behalf. It was suggested that Mrs Hunt contact the hospital Billing department and arrange to have funds sent directly to them but i do not know if this was ever done . It is also my understanding that the US Embassy in Manila can assist in setting this up for Mrs Hunt but i do not know if she has contacted them regarding this. Daisy did get a phone call from an Embassy rep a few days ago who stated they they would call the hospital . Again , do not know if that has been done yet. The biggest issue of course is getting Mr Hunt stablized so that he might be able to travel . His bills continue to mount daily of course and the last amount i heard was well over 200,000 . Hopefully his daily med costs will decrease soon as he gets better. In the end despite all of the folks trying to help Mr Hunt both here and abroad Mrs Hunt by being his legal wife is the one that basically has to initiate any kind of gov assistance on his behalf . That would include release of his diagnosis and medical records as requested by American doctor(s) and follow up on possible VA benefits . It is my understanding that the hospital is not keen on releasing the medical record so that is most likely a legal issue. As for the Yuma newspaper comments disappearing if that is the case i am certain that is also a legal issue . Daisy was asked to contact the newspaper but has chosen not to do so because of possible legal complaint being considered by Albert. The newspaper has it's own attorneys so they can deal with that. To be candid Daisy has about chosen to no longer assist in this case because of the time required not to mention all of the accusations being tossed about . My wife is a good hearted woman and those who know her personally know that she does not need to be defended to those who may not know her personally . I agree with Jil. We should focus on the problem at hand, (Hunt) and worry about the "paperwork" later. Hunt. This man was first hospitalized on about January 28th and was in a condition to be released and able to return (via commercial aircraft with a nurse assistance) to the US in February, if he had been the money to pay for his hospital bill or had someone signed a promissory note. However, his conditional has only declined. This man is a diabetic, who was diagnosed with a brain tumor, and apparently now some sort of Pneumonias or what they are calling Hospital Virus Syndrome. Although he was moved about 10 days ago to ICU, they have him classified as a out patient. This is again for the fact that his hospital bill is over 200,00 pesos. The doctor said last week that he should be stabilized in 7 days if he was provided the necessary daily medication. The daily medication is running about $250.00 -$300.00 per day. He is not getting all of his prescribed medications on a daily basis as these are purchased after receipt of donations being received. Although Daisy Cline has raised over $1,000.00 since Mr. Hunt was moved to ICU, I believe that Tom Hunt has only had his full regiment of medication on three of these days. Daisy and a few other ladies in her group have been working on a daily basis to assist Mr. Hunt. They have only been able to recently buy the two most important medications in different pharmacy's downtown CDO and apparently they are now dealing with the pharmacy's not having stock/inventory. These ladies have also requested and assisted in obtaining and paying for the three blood transfusions which were delayed because of not being able to obtain his rare type A Negative and had blood flown in from Cebu and Dumaguite. It is my understanding that Tom Hunt was unconscious for 2-3 days and then came out of this as a result of receiving his full regiment of medication on a few days. However, I understand as of yesterday that although he is conscious is disoriented and not always aware of who is with him. Our group has been doing everything that we can to assist this man. However, it appears Tom Hunts condition is again on a downward spiral. I spoke to Jeaneth who visited him in ICU yesterday and she said that he is in bad shape and has bloated or swollen throughout his body. The Nurse said that it is a pity that he can't obtain the medication he needs. I also spoke with Daisy at the hospital today trying to coordinate phone calls with Tom Hunt and his step-son (Ted Hammon) and his cousin Tara Smith. We were hoping that he could at least hear their voices and know he is loved. Daisy said that his condition is so bad its hard for her to see him like this. I realize that both of you gentlemen are very busy, but if you could take a few hours out of your busy schedule to please look into assisting this man with medication for 7-10 days so that his condition may be stabilized, you might be able to save his life. Once stabilized and depending upon his conditions at that time, he should be in a position to obtain a commercial med evac or a private med evac if necessary. It is a shame that he was not released from the hospital in February because he could not pay his bill as he would probably be in Phoenix today. With your immediate assistance and cooperation we might be able to save this mans life and return him home to the US VA Hospital in Phoenix where he can obtain a better medical evaluation and obtain the type of medication and care that we have in the US. Time is of the essence so I am requesting your immediate attention and assistance to see what can be done to bring this American Vet back home. In saying that I was taken aback by the apparent rapid deterioration in Toms condition this pm from last time I saw him which was just before I left for Manila. Equally clear is that any notion of Tom being repatriated under his present level of ICU treatment is not going to happen unless it is a dedicated E VAC . No commercial carrier will I believe accept a seriously ill patient, unless instructed by a government agency. I believe Tom now falls into this category. Reality would suggest that unless Tom makes a sudden recovery from his present medical position, then his stay in ICU in CDO is now looking like being full time. There have been many people who have been positive, helpful and supportive of Tom. He is probably not even aware that he is receiving such support, his condition appears to be such. What is need is funding, yes sorry but its all down to money and the lack of it. Perhaps if the well meaning people who are making such an important contribution can now focus entirely on providing such a solution it will count for more than anything else at this time. I went inside the ICU this morning and talk to him and able to let him hear his step son Mr. Hammond on my mobile phone. I was touched as he was on his senses and wanting to reach out for my phone to talk to him but as he`s intubated so its not possible. I could tell he was glad to hear his sons voice who gave him assurance that they are trying their best of having him send back to the US , so they will be together again. I told him to be strong and to hang on. I asked him can you promise me this? He nod his head many times .. a YES! He is fighting! I just hope there will always be enough funds for his medicines as two of the nurses informed me their were days that Jane Laze`s family were not able to provide drugs to Mr. Hunt. I see him a lot better and responsive today. I would like to suggest to everyone here, to pay him a visit when you have the chance. It will mean a lot to him. Upon request of Ted, the hospital allowed us to take some pictures but at this time I am so sorry to say that my partner Jill has to wait until tomorrow to download those pictures from her phone to her PC. We have the chance to talk with the nurses and they are all thumbs up by the cooperation that they get from Mr Hunt! All of them said that with just continues medication, Mr. Hunt will really make it! We told him Tommy hung on...and he nod his head and even try to speak! For awhile the ICU became a venue for picture taking! Yes he is in a critical condition but a very good patient!!! He responded to all his medicines positively! He is recommended for another CT scan, CBC, Potassium, Sugar level laboratory tests! Will require around 6000 pesos more or less because CT scan is around 5K already! I am not a medical person but he is improving a lot from the first time he was in the ICU! However, we didn't go to the hospital because I already asked Janelaze yesterday to take care of today's medicine because I already have loans to individuals just to be be able to complete the medicines last Monday, Tuesday (was not able to give completely) Wednesday, thursday and Friday. Janelaze and her family knew that we already borrowed money just to be able to provide the medicines for Mr Hunt. Empty promises to forward information and numbers of people he has spoken with so that I could follow up on what he and Janelaze are pursuing. Doubt very seriously that he has done any of it. At this time if I attempted such an adventure I would most likely lose my job and jeopardize my own immediate family (wife & kids), and knowing my step-father he would not want me to do that. On my behalf I can't say enough thanks for all everyone is doing. I feel so lost in all of the dead ends I keep hitting with the government agencies. It seems that Janelaze has this whole situation under her control, and the irratating part of it all is that she isn't even a citizen, but can take advantage of all the rights of a citizen and spouse. In regards to what your group can do to assist. I would only hope that those on the grounds in CDO would continue to provide encouragement to Tommy as their own lives and schedules permit. Those that have a little extra to share and feel it is a worth cause to do so, I like the idea of direct with the hospital if need be. I don't think I really trust the family to use the funds as they should be. If they had been, I don't think Tommy would be in the situation he is in. From what I have learned about Janelaze and her events since coming to the USA, I don't think she ever really cared about Tommy, but was just waiting for time to soak him of money and the breath of life he had left. If ever I have occassion to meet any of you in person, I would jump at the chance, for you all are truly compassionate people. You will not receive anything from the Military records group. They shall just mail you a copy of the DD 214. I highly recommend that you take advantage of Mike Farrell's offer to send letters to the Department of Social Security, DOD and the FBI. However, you will need to e-mail Mike and provide him with Tom's complete name, SS#, previous address in Yuma or your present address, birth date, etc.. In regards to sending money directly to the hospital, you can do this, but please understand that at this point they will probably just apply any money received to his past due hospital bill and this may NOT go towards his daily medications. If you believe Albert that funds can be sent through the American Embassy, I would first check with them and see how they will assist in buying Tom's daily medications. If you want to make sure that Tom is getting the required daily medications in effort to stabilize his condition in an attempt to give him some more time on this earth and perhaps return to the US where we know he will receive the proper care, then I highly recommend that convince family, friends and fellow church members of Tom to gather funds immediately and send them to the bank account that Daisy and the Ladies Charity organization established on his behalf. These ladies along with Jane Laze sister, are obtaining the funds and purchasing the medications together. Daisy is assuring that every dollar is going for his medication or blood donations and accounts for every dollar. However, I suggest that perhaps someone on the ground in CDO go to Tom's doctor, see if he has an e-mail address and obtain his address and phone contact information, and if possible to be with Tom's doctor when he calls the VA office in Hawaii and speaks to either Terry Amimoto or Doctor Andrus. Since composing this e-mail, I received a call from Terry Amimoto. I explained the basic information regarding Tom's medical issues, hospitalization to Terry and told her that I shall follow-up with an e-mail to she and Dr. Andrus. I told her that our goal is to provide Tom with the daily medications to stabailize him to the point that he can be transported back to the US and that it is Tom's desire to return to Arizona. She did advise me that she has never been involved with anything along this line before, but said that she will look into this and do whatever she can to assist with efforts to have Tom enrolled in the VA, perhaps, obtain payments for Hospitalization, medications and transportation to either Hawaii or Arizona, depending upon his actual condition. I told her that we shall try to have Tom's doctor call her office and also try to arrange to obtain medical records and provide these to them. She asked who is the primary contact and I told her that I shall be their primary contact here in the US, but advised that I shall include Jane Laze and Albert on all communications. Thomas Hunt has been hospitalized in Cagayan de Oro City, Philippines since January 28, 2009. Since his hospitalization, the Doctor had medically released him sometime in mid February, but the hospital would not discharge him as his hospital bill was not paid nor did they receive a Promissory Note of Payment. About two weeks ago last Saturday, Mr. Hunt was moved to the ICU Unit of the hospital as he apparently had internal bleeding (blood was obvious from his mouth and nose). It is also our understanding that they did have issues with controlling his diabetes as his Blood Sugar Level was 323. Unfortunately they did not do this and since then Tom's condition deteriorated and was unable to sign these. Perhaps, Jane Laze can provide Ted with the Power of Attorney and Medical Power of Attorney to assist his Dad as Tom is not in a condition that he can do so. This would allow Ted to move forward to apply for VA assistance and Medicare/Medical for Tom. These organizations could assist in paying for Tom's medication, Hospital bill and return to the US. This would also take the pressure off all of us trying to raise funds on Tom's behalf for his daily medications and then the hospital bill. These things really need to be accomplished ASAP. If Tom is going to be returned to the US, these efforts must be accomplished either by Jane Laze or Ted so that Tom has a place to go when he does return to the US. If Jane Laze does not provide Ted with Power of Attorney to accomplish these tasks, then Jane Laze needs to accomplish these efforts herself ASAP. When Tom has been approved for the VA and Medical/Medicare benefits, these documents need to be provided to the US Embassy, the Hospital and any organizations involved in his assistance. As Daisy stated yesterday after her meeting with the hospital executives, these things should make the difference. Please understand that had Tom had Medical/Medicaid and VA assistance, we would not be in a position to raise funds daily and the people on the ground in CDO would not have to go through their daily efforts to obtain the cash, go to two different pharmacies and then to the hospital to provide the medications to the ICU and to coordinate the medications on a daily basis. We believe that Tom probably would have been released in February and returned to the US if he had the assistance from the VA and Medical/Medicaid.. Let me give a just hypothetical situation so maybe someone will take me serious. I first ask one question did Mr. Hunt have a copy of a DD214, was told not for sure but someone thought so. If so, that is easy enough to get and I gave someone even the address where to write for it, also telling them that some people of Mr. Hunts age when getting out of the Military filed a copy of their DD214 with the court house which was required at one time, no longer the case. Number two, has Mr. Hunt ever been enrolled at any stateside or here in the Philippines for the Philippines is the only place besides Guam where a military retiree or NOW LISTEN SERVICE CONNECTED PERSON WITH A VERIFIABLE DISABILTY OR COMPENSATION AND PENSION CAN RECEIVE FREE MEDICAL CARE AT THE CLINIC IN MANILA. As it stands it appears to me that Mr. Hunt was never in the military at a time of a conflict, police action, national guard call up by the president, or a declared war. That still doesn't mean he can not avail himself of VA health care if he is indeed enrolled at the VA Clinic in Manila. I just got off the phone for an hour and half with several people at the clinic at Manila, of course without his SSN and power of attorney they would only answer so much, but after they looked me up in the computer find my own case number to be "restricted" they knew I had worked before for the VA, which most of them do, so they were very generous with their answers. They asked me was he already enrolled at the VA clinic, I said according to the group yes, someone from Hawaii put him in the system. Now here I am playing devil's advocate, if I believe what has been said and he is enrolled, for I know in my time I could enroll someone in a matter of minutes even if that person had never set foot in my clinic before, for if I had a copy of a DD214 proving he/she had served over 190 days without a dishonorable discharge I would enroll them. The next step is within 30 days they have by law have their first appointment with a primary care physician which in Mr. Hunts, the VA said the same thing. He needed to be physically able to come to the clinic to be seen by a doctor who if after that felt he needed this or that type of medication he would then be given it at a discount or a co pay, it used to 2 dollars per RX per month, but that was years ago and I think it is at least 7 or higher now. What is FEE BASIS, fee basis is where the VA because you have a SERVICE CONNECTED DISABILITY RATED AT 50% or more or entitled if it is an emergency and you are already Service Connected under VA law that there are several hospitals accredited within the PHILIPINNES, THAT after a letter of approval you can go there and the VA will be responsible for your total and complete care. I asked the specific question, if Mr. Hunt is not Service Connected for any of these disease he is currently having does the VA have an obligation to pay for him to be in a private Hospital. Could he get FEE BASIS for such, the answer was not mine but there's an absolute NO! If we could get Mr. Hunt to directly appeal his case to the US Embassy through the Department of Veterans Affairs and they sent the VA clinic all of his medical records, there stand a remote possibility that they could under some circumstances provide the medications but that is still not a given. Once again I plead all of you to make absolutely sure of the facts before you pen them to paper. Let it be KNOW I DO NOT KNOW THE FACTS, I only base my decisions based on your alls email, like now I am so confused about the money issue and his SS being stopped , in my very first letter, I told someone that the first that needed to be done was to notify Social Security. I have prayed heart out on a daily basis over this man's plight for he is, combat or not, just like Tom my brother. But you people are talking about private air hospitalization flights that could run you into the 50,000 dollar range all according to the type of critical care they need to perform on the trip home. I have a customer, that has asked me to stop a production assembly line as they are not happy with their internal design of a SS spring and has asked that we take control over the design and design our own SS Spring immediately, validate it, get it approved and implement immediately into production I was swamped on Wednesday and hit the road early Thursday morning and drove to Nevada for meetings all afternoon and evening. I was advised by Wells Fargo that the remittance account I established has to be closed because it is a business/corporate account at BPI.
